Terms of Service

Welcome to Atlas. These Terms of Service ("Terms") govern your use of the Atlas mobile application (the "App") operated by Horacio Garza ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms.

IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THE APP.

1. Acceptance of Terms

By accessing or using Atlas, you confirm that:

  • You are at least 13 years of age (or the minimum age required in your jurisdiction)
  • If you are under 18, you have obtained parental or guardian consent
  • You have the legal capacity to enter into a binding agreement
  • You agree to comply with these Terms and all applicable laws

2. Description of Service

Atlas is an AI-powered micro-learning application that provides personalized educational content across various subjects. The App offers:

  • AI-Generated Lessons: Personalized content powered by Anthropic's Claude AI
  • Progressive Learning: Five difficulty levels (Foundations, Intermediate, Advanced, Expert, Mastery)
  • Progress Tracking: Streaks, achievements, and learning analytics
  • Customizable Experience: Teaching styles, interaction levels, and reading preferences
  • Subscription Tiers: Free, Premium, and Super Premium plans with varying features

3. Subscription Plans and Billing

3.1 Subscription Tiers

Atlas offers three subscription tiers:

Free Tier

  • 1 lesson per day
  • Claude Haiku AI (basic quality)
  • Up to 3 topics maximum
  • Default app icon only
  • Advertisements displayed

Premium Tier

  • 2 lessons per day
  • Claude Sonnet AI (advanced quality)
  • Up to 10 topics
  • Deep dive lessons unlocked
  • Most premium app icons
  • Reduced advertisements
  • Pricing: Available as monthly or yearly subscription (prices displayed in App Store)

Super Premium Tier

  • 4 lessons per day
  • Claude Opus AI (best quality)
  • Unlimited topics
  • Expert and Mastery levels unlocked
  • All premium and exclusive app icons (Magician, Knight, Faceless, Princess, Scholar)
  • Completely ad-free
  • Pricing: Available as monthly or yearly subscription (prices displayed in App Store)

3.2 Subscription Purchase and Payment

  • Payment Processor: All subscriptions are processed through Apple's App Store
  • Payment Method: Your iTunes Account will be charged at the time of purchase confirmation
  • Pricing: Current subscription prices are displayed in the App and App Store, shown in your local currency
  • Taxes: You are responsible for any applicable taxes or fees

3.3 Auto-Renewal Terms

IMPORTANT - PLEASE READ CAREFULLY:

  • Automatic Renewal: Your subscription will automatically renew at the end of each billing period (monthly or yearly) unless you cancel at least 24 hours before the renewal date
  • Renewal Charge: Your iTunes Account will be charged for renewal within 24 hours prior to the end of the current period at the same price you originally paid
  • Price Changes: We reserve the right to change subscription prices. You will be notified of price changes at least 30 days in advance. If you do not agree with the new price, you may cancel your subscription before the price change takes effect.
  • Managing Subscriptions: You can manage your subscriptions and turn off auto-renewal at any time by going to your iTunes Account Settings after purchase

3.4 Free Trials

  • Trial Period: We may offer free trial periods for Premium or Super Premium subscriptions
  • Trial Duration: Trial length (if offered) will be clearly stated at the time of subscription
  • Trial Conversion: If you do not cancel during the trial period, your subscription will automatically convert to a paid subscription and you will be charged
  • Trial Forfeiture: Any unused portion of a free trial period will be forfeited when you purchase a paid subscription
  • Trial Eligibility: Free trials may be limited to new subscribers only, and we reserve the right to determine trial eligibility

3.5 Cancellation and Refunds

How to Cancel:

  1. Open iOS Settings
  2. Tap your name at the top
  3. Tap "Subscriptions"
  4. Select "Atlas"
  5. Tap "Cancel Subscription"

Cancellation takes effect at the end of your current billing period. You will retain access to premium features until the subscription expires.

Refund Policy:

  • Apple's Refund Policy Applies: All subscription purchases are subject to Apple's refund policy, not ours
  • Requesting Refunds: To request a refund, contact Apple Support directly:

    Or through iOS Settings → [Your Name] → Media & Purchases → View Account → Purchase History
  • No Partial Refunds: We do not offer partial refunds for unused portions of subscription periods
  • Discretionary Refunds: Apple may grant refunds at their sole discretion based on their policies
  • Our Refund Authority: We do not have the ability to issue refunds for App Store purchases; only Apple can process refunds

Downgrading Subscriptions:

  • If you downgrade from Super Premium to Premium or from Premium to Free, the change takes effect at the end of your current billing period
  • App Icon Reset: If you downgrade to a tier that doesn't support your currently selected app icon, the icon will automatically reset to the default
  • Feature Access: You will lose access to features exclusive to your previous tier (e.g., Expert/Mastery levels, unlimited topics)

4. User Accounts and Content

4.1 Account Creation

  • Atlas does not currently require account creation with username/password
  • Your data is stored locally on your device and optionally synced via your iCloud account
  • You are responsible for maintaining the security of your device

4.2 User-Generated Content

When using Atlas, you create content such as:

  • Custom topic names and subject descriptions
  • Quiz responses
  • Reading preferences and settings

Content Ownership:

  • You retain ownership of content you create
  • By creating content in the App, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and process your content solely for the purpose of providing and improving the App services

Content Restrictions:
You agree NOT to create content that:

  • Is illegal, harmful, threatening, abusive, harassing, defamatory, or hateful
  • Infringes on intellectual property rights of others
  • Contains viruses, malware, or malicious code
  • Violates any applicable laws or regulations
  • Promotes violence, discrimination, or illegal activities

4.3 AI-Generated Content

Important Disclaimers:

  • Third-Party AI: Lesson content is generated using Anthropic's Claude AI, a third-party service
  • No Accuracy Guarantee: AI-generated content is provided for educational purposes only. We do not guarantee the accuracy, completeness, or reliability of AI-generated lessons
  • Not Professional Advice: Content is not a substitute for professional advice in any field (medical, legal, financial, etc.)
  • Educational Use Only: Content is intended for personal learning and educational purposes
  • User Responsibility: You are responsible for verifying information and using your own judgment when learning from AI-generated content

Content Licensing:

  • AI-generated lessons are licensed to you for personal, non-commercial use only
  • You may not redistribute, sell, or commercially exploit AI-generated content
  • You may not use AI-generated content to train other AI models

5. Intellectual Property Rights

5.1 App Ownership

The Atlas App, including all code, design, graphics, logos, user interface, and functionality, is owned by Horacio Garza and protected by:

  • United States and international copyright laws
  • Trademark laws
  • Other intellectual property rights

5.2 Anthropic Claude AI

  • Lesson content is generated using Anthropic's Claude AI
  • Claude AI is owned and operated by Anthropic PBC
  • Use of Claude AI is subject to Anthropic's terms and policies

5.3 App Icons and Branding

  • All app icon designs (including premium and exclusive icons) are our intellectual property
  • The "Atlas" name and logo are trademarks owned by Horacio Garza
  • You may not use our trademarks, logos, or branding without written permission

5.4 Your License to Use the App

We grant you a limited, non-exclusive, non-transferable, revocable license to:

  • Install and use the App on devices you own or control
  • Access and use App features according to your subscription tier
  • Create and store personal learning content

License Restrictions:
You may NOT:

  • Modify, reverse engineer, decompile, or disassemble the App
  • Remove or alter any copyright, trademark, or proprietary notices
  • Distribute, sublicense, rent, lease, or lend the App to others
  • Use the App for any illegal or unauthorized purpose
  • Attempt to extract the source code or underlying algorithms
  • Use automated tools to access the App (bots, scrapers, etc.)

6. Acceptable Use Policy

You agree to use Atlas in a lawful and respectful manner. Prohibited uses include:

6.1 Prohibited Activities

  • Abuse of AI Services: Attempting to generate harmful, illegal, or inappropriate content
  • System Interference: Attempting to disrupt, damage, or impair the App's functionality
  • Unauthorized Access: Attempting to access other users' data or restricted areas of the App
  • Data Mining: Using automated tools to extract data from the App
  • Commercial Exploitation: Using the App or its content for commercial purposes without authorization
  • Fraudulent Activity: Creating fake accounts, manipulating progress data, or abusing free trials
  • Circumventing Limits: Attempting to bypass daily lesson limits or subscription restrictions

6.2 Enforcement

If you violate these Terms:

  • We may suspend or terminate your access to the App immediately
  • We may delete your account and all associated data
  • You may lose access to paid subscriptions without refund
  • We may report illegal activities to law enforcement

7. Service Availability and Modifications

7.1 Service Availability

  • No Guarantee of Uptime: We strive to provide reliable service but do not guarantee uninterrupted or error-free access
  • Scheduled Maintenance: We may perform maintenance that temporarily interrupts service
  • Third-Party Dependencies: Atlas relies on third-party services (Anthropic Claude AI, Apple iCloud, Google Ads). We are not responsible for outages or issues caused by third parties.

7.2 Modifications to the App

We reserve the right to:

  • Add, modify, or remove features at any time
  • Change the user interface or design
  • Update AI models or content generation algorithms
  • Modify subscription tier benefits (with advance notice for existing subscribers)
  • Discontinue the App entirely (with 30 days notice)

7.3 Updates and Support

  • App Updates: We may release updates to improve functionality, fix bugs, or add features. You are responsible for installing updates.
  • iOS Requirements: Atlas requires iOS 17.0 or later. We may discontinue support for older iOS versions.

8. Privacy and Data Protection

8.1 Privacy Policy

Your use of Atlas is also governed by our Privacy Policy, available at:

By using the App, you consent to the data practices described in the Privacy Policy.

8.2 Key Privacy Points

  • Data Collection: We collect learning progress, user-generated topics, and usage analytics
  • AI Processing: Topic requests are sent to Anthropic's Claude AI for content generation
  • Advertising: Free tier users see ads powered by Google Mobile Ads SDK
  • iCloud Sync: If enabled, your data is stored in your personal iCloud account
  • Your Rights: You can access, export, or delete your data at any time

9. Disclaimers and Limitation of Liability

9.1 Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Accuracy: We do not warrant the accuracy, completeness, or reliability of AI-generated content
  • Fitness for Purpose: We do not guarantee the App will meet your specific needs or expectations
  • Uninterrupted Service: We do not guarantee error-free or uninterrupted service
  • Security: While we implement security measures, we cannot guarantee absolute security
  • Educational Outcomes: We make no guarantees regarding learning outcomes or knowledge retention

9.2 Educational Content Disclaimer

IMPORTANT:

  • Atlas provides general educational content for informational purposes only
  • Content is NOT a substitute for professional advice (medical, legal, financial, scientific, etc.)
  • Do not rely solely on AI-generated content for important decisions
  • Always verify information with credible sources and experts
  • We are not liable for decisions made based on App content

9.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • No Consequential Damages: We are not liable for any indirect, incidental, special, consequential, or punitive damages
  • Maximum Liability: Our total liability to you shall not exceed the amount you paid for subscriptions in the 12 months prior to the claim
  • Excluded Damages: We are not liable for:
    • Lost profits, revenue, or business opportunities
    • Loss of data or content
    • Costs of substitute services
    • Emotional distress or reputational harm
    • Third-party claims

9.4 Jurisdictional Variations

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, our liability is limited to the greatest extent permitted by law.

10. Indemnification

You agree to indemnify, defend, and hold harmless Horacio Garza, Atlas, and our affiliates, partners, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

  • Your use or misuse of the App
  • Your violation of these Terms
  • Your violation of any third-party rights (intellectual property, privacy, etc.)
  • Content you create or submit through the App
  • Your violation of any applicable laws or regulations

11. Termination

11.1 Termination by You

You may stop using the App at any time by:

  • Uninstalling the App from your device
  • Canceling your subscription (as described in Section 3.5)
  • Deleting your data via Settings → Delete Account

11.2 Termination by Us

We may suspend or terminate your access to the App immediately if:

  • You violate these Terms
  • You engage in fraudulent or illegal activity
  • Your use of the App poses a security risk
  • Required by law or legal process
  • We discontinue the App

11.3 Effects of Termination

Upon termination:

  • Your license to use the App is revoked
  • You must stop using the App and uninstall it
  • Your data may be deleted (subject to our data retention policies)
  • No Refunds: Termination for cause does not entitle you to a refund
  • Surviving Provisions: Sections 5 (Intellectual Property), 9 (Disclaimers), 10 (Indemnification), and 12 (Governing Law) survive termination

12. Governing Law and Dispute Resolution

12.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles.

12.2 Jurisdiction and Venue

You agree that any legal action or proceeding arising from these Terms shall be brought exclusively in the state or federal courts located in San Francisco County, California. You consent to the personal jurisdiction of these courts.

12.3 Apple's Role

  • Apple Inc. is not a party to these Terms
  • Apple is not responsible for the App or its content
  • Apple has no obligation to provide support or maintenance
  • You acknowledge that these Terms are between you and Horacio Garza, not Apple

12.4 Dispute Resolution

Informal Resolution: Before filing a legal claim, you agree to contact us at atlas.learn.everything@gmail.com to attempt to resolve the dispute informally.

Small Claims Court: You may bring claims in small claims court if they qualify.

12.5 Class Action Waiver

YOU AND HORACIO GARZA AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

If this waiver is found unenforceable, the entire arbitration provision (if applicable) is void.

13. International Use

13.1 Export Compliance

The App is controlled and operated from the United States. You agree to comply with all applicable export and import laws, including U.S. Export Administration Regulations.

13.2 International Users

If you access the App from outside the United States:

  • You are responsible for compliance with local laws
  • Your data may be transferred to and processed in the United States
  • You consent to the transfer and processing of your data as described in our Privacy Policy

14. Miscellaneous Provisions

14.1 Entire Agreement

These Terms, together with our Privacy Policy and any supplemental terms, constitute the entire agreement between you and us regarding the App.

14.2 Amendments

We may modify these Terms at any time by posting revised Terms in the App. Changes take effect immediately upon posting. Your continued use of the App after changes constitutes acceptance of the modified Terms.

We will notify you of material changes via in-app notification.

14.3 Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force and effect.

14.4 Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

14.5 Assignment

You may not assign or transfer these Terms or your rights under them. We may assign these Terms to any affiliate or successor without your consent.

14.6 No Third-Party Beneficiaries

These Terms do not create any third-party beneficiary rights except as expressly stated (e.g., Apple's disclaimers).

14.7 Language

These Terms are written in English. Any translations are provided for convenience only. In case of conflict, the English version prevails.

14.8 Survival

Provisions that by their nature should survive termination (including intellectual property, disclaimers, limitations of liability, indemnification, and governing law) will continue to apply after termination.

16. Apple End User License Agreement (EULA)

In addition to these Terms, your use of the App is subject to Apple's Licensed Application End User License Agreement (Standard EULA), which is incorporated by reference. You can find Apple's Standard EULA at:

Key Points from Apple's EULA:

  • The App is licensed, not sold, to you
  • You may install the App on devices you own or control that run iOS
  • You may not rent, lease, lend, sell, redistribute, or sublicense the App
  • Apple has no obligation to provide maintenance or support
  • Apple is not responsible for product warranty claims, legal compliance issues, or consumer protection claims

In Case of Conflict: If these Terms conflict with Apple's Standard EULA, Apple's EULA takes precedence with respect to your use of the App on iOS devices.

17. Acknowledgment and Agreement

BY CLICKING "I AGREE" DURING THE SUBSCRIPTION PURCHASE PROCESS, OR BY DOWNLOADING, INSTALLING, OR USING THE APP, YOU ACKNOWLEDGE THAT:

  1. You have read and understood these Terms of Service
  2. You agree to be bound by these Terms
  3. You are of legal age to enter into a binding agreement
  4. If you are under 18, you have obtained parental/guardian consent
  5. You understand the subscription terms, auto-renewal, and cancellation policy
  6. You have reviewed the Privacy Policy and consent to data practices described therein
  7. You understand that AI-generated content is for educational purposes only and may not be accurate
  8. You agree to use the App in compliance with all applicable laws

  • Subscriptions auto-renew unless canceled 24 hours before renewal
  • Refunds are handled by Apple, not us, and are subject to Apple's policies
